By using our website located at nextstepsfunding.net, scheduling a consultation, submitting a pre-qualification form, or engaging any of our services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms.
These Terms apply to all visitors, users, and others who access or use our services. If you are using our services on behalf of a business or other entity, you represent and warrant that you have authority to bind that entity to these Terms.
Services Provided
Next Steps Funding provides loan brokerage consulting services, including but not limited to:
- Free initial consultations to assess your financial situation and funding needs
- Identification and matching of appropriate loan products from third-party lenders
- Credit repair guidance and referral services
- Educational resources related to business financing, loan types, and credit management
- Ongoing support and credit monitoring referrals throughout the loan process
We act as an intermediary between you and potential lenders. We do not ourselves provide loans, extend credit, or make lending decisions.
Eligibility
To use our services, you must:
- Be at least 18 years of age
- Be a resident of the United States
- Have the legal capacity to enter into binding agreements
- Provide accurate, truthful, and complete information when requested
We reserve the right to decline service to any individual or entity at our sole discretion, including where providing services would violate applicable law or regulation.
No Guarantee of Funding
Next Steps Funding makes no representations or warranties that you will qualify for any loan product, receive any particular interest rate or loan amount, or that any lender will approve your application. We work diligently to match clients with suitable lending options, but ultimate credit and lending decisions rest entirely with the lenders we refer you to.
Pre-qualification through our intake forms does not constitute a loan commitment or approval from any lender.
We Are Not a Lender
Next Steps Funding is a loan brokerage and consulting service. We are not a bank, credit union, mortgage company, or licensed lender. We do not:
- Make lending decisions
- Extend credit or loan funds
- Set interest rates or loan terms
- Hold or process loan proceeds
- Guarantee any specific outcome with any lender
Any loan you receive will be from a third-party lender with its own terms, conditions, rates, and legal agreements that will govern your loan. You are responsible for reviewing and understanding all terms presented by any lender before signing any agreement.
Fees & Compensation
Initial consultations with Next Steps Funding are provided at no charge. We may be compensated by lenders or other third parties if you obtain a loan or financial product through our referral. This compensation does not affect the cost of your loan — any fees, origination costs, or charges related to your loan will be disclosed by the lender directly.
If any fee-based services are offered, the nature and amount of those fees will be clearly disclosed to you in writing prior to your agreement to pay.
Privacy & Data Use
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
Information We Collect
When you submit our pre-qualification form or book a consultation, we collect personal and financial information including your name, contact details, address, income information, credit score estimates, and business information. This information is used solely to assess your needs and match you with appropriate loan products.
Information Sharing
We may share your information with:
- Third-party lenders and financial institutions for the purpose of evaluating your loan eligibility
- Credit repair service providers where you have requested such services
- Service providers who assist in our operations (subject to confidentiality obligations)
We do not sell your personal information to marketers or data brokers.
Communications Consent
By providing your phone number and email address and checking the applicable consent boxes on our forms, you expressly consent to receive communications from Next Steps Funding, including:
Transactional Communications
Messages related to your consultation, application status, account updates, appointment reminders, and other service-related communications. These may be sent via SMS/text message, phone call, or email. Message frequency varies.
Marketing Communications
Promotional messages, special offers, educational content, and product updates, where you have separately consented to receive such messages.
Standard message and data rates may apply to SMS communications. You may opt out of text messages at any time by replying STOP. For assistance, reply HELP. Opting out of marketing communications will not affect transactional messages related to active services.
Accuracy of Information
You agree to provide accurate, current, and complete information in all interactions with Next Steps Funding, including all forms, consultations, and communications. You further agree to update information promptly if it changes.
Providing false, misleading, or incomplete information may result in immediate termination of services, potential referral to appropriate authorities, and civil or criminal liability under applicable law. Misrepresentation on a loan application is a federal crime.
Intellectual Property
All content on the Next Steps Funding website — including text, graphics, logos, images, and software — is the property of Next Steps Funding or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.
Nothing in these Terms grants you any license or right to use any trademark, trade name, service mark, or logo of Next Steps Funding or any third party.
Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, NEXT STEPS FUNDING DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties that services will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or completeness of any information provided
- Warranties that any loan product will be available, suitable, or approved for you
We do not warrant or represent that any lender we refer you to is suitable for your specific needs. You are solely responsible for independently evaluating any lender and their terms before entering into any financial agreement.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXT STEPS FUNDING AND ITS OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunity
- Loan denials or unfavorable loan terms received from third-party lenders
- Decisions made by third-party lenders regarding your creditworthiness
- Errors or inaccuracies in information provided by third parties
- Unauthorized access to your personal or financial data by third parties
In no event shall our total liability to you for all claims arising out of or related to our services exceed the total amount of fees paid by you to Next Steps Funding in the twelve (12) months preceding the claim, or $100.00, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Next Steps Funding and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of or inability to use our services
- Your violation of these Terms
- Your violation of any third-party right, including any lender agreement
- Any false or inaccurate information you provided
- Any claim that your use of our services caused damage to a third party
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms or our services shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.
Informal Resolution
Before filing any formal legal claim, you agree to first contact us at info@nextstepsfunding.net and provide written notice of the dispute. We will attempt in good faith to resolve any dispute informally within 30 days of receiving notice.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.
